Administration of Estates

*NOTE* Pursuant to this Court’s Local Rule 75.1, which became effective August 12, 2021, any person wishing to represent themselves in any probate action in this court shall review, sign, and file the attached Self-Representation Acknowledgement when engaging in a probate proceeding without legal representation.

One of the largest responsibilities of the Probate Court would be the supervision of decedents’ estates.

The estate administration process involves the appointment of a fiduciary (executor or administrator) when necessary. This fiduciary has the responsibility to collect all of the assets of the decedent, pay any legal debts and obligations and distribute the remaining assets to those persons entitled to inherit.

There are three different proceedings that could be filed in a decedent’s estate. Please see the PROBATE FAQ section for more information on these estate proceedings.

Medical Records of Decedent

Occasionally an interested person may have a need to access the decedent’s medical and medical billing records for use in evaluating a potential wrongful death, personal injury, or survivorship action on behalf of a decedent. The estate may not yet be open. Revised Code Section 2113.032 provides a means by which any person who is eligible to be appointed as a personal representative of an estate under the law of this state or named as executor in a will may file an application to obtain the release of medical records and medical billing records of the decedent. The filing is made with the probate court of the Ohio county in which the decedent resided at death

Each application must be accompanied by a completed Form 1.0 identifying the name, address, and relationship of the decedent’s known surviving spouse, children, next of kin, legatees, and devisees, if any.

If the applicant is relying on the decedent’s will as the basis for the application, a copy of the will showing the name of the nominated individual must be filed with the application and the original must be displayed to the Court.

Unless waivers of notice from all interested parties are filed with the application, the Court will send a copy of the application to the interested parties and wait at least 10 days after the application is sent before acting upon the application. Absent waivers of notice from all interested parties, the application will be scheduled for a non-oral hearing to allow proper service of the notice.

The medical records case is open until the applicant files a final status report confirming that the records have been obtained. A status report from the applicant shall be due three months from the date of the issuance of the Court’s entry and again at succeeding six months intervals thereafter, until the final status report is filed confirming the records have been obtained.

Filing Instructions

  1. The decedent must have been a resident of Pike County at death.
  2. Completed applicable forms from those listed below.
  3. A completed Form 1.0 (Surviving Spouse, Children, Next of Kin, Legatees and Devisees). This form can be found in the standard probate forms for estates
  4. If the Will is the basis for the applicant’s eligibility to apply, then the original Will must be provided to the Court. (A copy will be made, and the original returned)
  5. A certified copy of the death certificate must be presented to the Court upon filing of the application. (A copy will be made, and the certified copy returned)
  6. Filing fees of $30.00

Creditor's Claims

Pursuant to Ohio Revised Code 2117.06(B), "Except as provided in section 2117.061 of the Revised Code, all claims shall be presented within six months after the death of the decedent…"

All claims shall meet the requirements of Ohio Revised Code 2117.06 and shall be accompanied with a filing fee of $10.00 per claim.

There are no standard probate forms for creditor's claims. If you have any questions concerning the filing of claims, including form and content, you should seek the advice of an attorney.
